General Duty Clause, Section 5(a)(1) of the Occupational Safety and Health Act, requires that each employer furnish to each of its employees a workplace that is free from recognized hazards that are causing or likely to cause death or serious physical harm

Lawsuits related to workplace violence have been brought against employers under this section
Cal OSHA
2017 | Workplace Violence regulation title 8 section 3342 required certain healthcare facilities to enact a workplace violence prevention program
2018 | Draft version #2 was completed title 8 section 3343 which will require General Industry (everyone else) to enact a workplace violence prevention program.
Anticipated date of implementation is 2020.
